What to Expect When You File a Claim

Filing an Employment Law Claim

Once it is determined that a lawsuit is necessary to seek compensation for your damages, we will draft a complaint and file it in the appropriate court. Once the complaint has been filed, you have entered the litigation phase of your case.

What Happens Next

Although each case is unique and can resolve at any point in the litigation, it is essential that you understand that litigation can take a long time. After a lawsuit is filed it will take at least one year until there is a trial of the matter. In some jurisdictions, it is not uncommon for it to take more than two years for a case to reach a trial. And, depending on the outcome of the trial, the case may not be completely resolved until six months or more until after the trial is completed. In sum, it can be a very lengthy process.

Your Involvement

Despite the length of the litigation and the vast amount of work that is completed by the attorneys in preparing a case for trial, your participation in the litigation will have peaks and valleys. For example, just after a lawsuit is filed, while the defendants are preparing a response to the complaint, it is likely that the need for your assistance will be minimal. Soon after, however, the case will enter the "discovery" phase of litigation. At that point, you will become very involved in the case. You will need to sit for your deposition by the opposing party. You will also need to be present when we depose the defendants and their witnesses. We will also contact you to assist in answering written discovery which has been sent by the defendants. For these reasons, it is essential that you always update us with your current contact information so that we may reach you at any time. Your participation in the process is essential.
